Waiver Requests

In Rule XX(e), Rules Governing Admission to the Bar of Texas, the Supreme Court gives the Board the authority to waive specific requirements of the rules, for good cause shown to the satisfaction of the Board, unless it appears that no exception to a particular requirement is contemplated by the Supreme Court.

Please note that waiver requests must be submitted in writing using a Waiver Request Form, and only written requests are considered. Waiver requests are considered by panels of the Board, which meet, generally, on a monthly basis.  Because deliberation is based on the written submission, persons who submit waiver requests are not required to attend. However, meetings are open to the public, and agendas for scheduled meetings may be viewed at the Texas Secretary of State's Texas Register Open Meetings website at http://info.sos.state.tx.us/pub/plsql/pubomquery$.startup   The Board is unable to exclude members of the public from attending its deliberations on waiver requests, so that during the Board panel's deliberation, the contents of a request for waiver are subject to discussion in an open meeting.

Special REQUEST FOR WAIVER OF FIVE-TIME LIMITATION in Rule XI(f). On December 12, 2006, the Supreme Court amended the provisions of Rule XI(f) concerning the Board’s authority to consider exceptions to the court’s rule that an examinee may take no more than five (5) bar examinations. Requests for waivers of Rule XI(f) must be submitted in writing using the REQUEST FOR WAIVER OF FIVE-TIME LIMITATION Form. You cannot use the general waiver request form for a Rule XI(f) waiver request, and the Board will not consider requests to waive any other Rules Governing Admission to the Bar of Texas in conjunction with your Rule XI(f) waiver request. Do not submit the request before reaching the XI(f) limitation or while you are awaiting grade release for the last exam taken. Any Request for Waiver of Five-Time Limitation must be properly completed and it must be submitted at the same time with a Re-Application to take the Texas Bar Exam and all applicable filing fees.  The Board is unable to exclude members of the public from attending its deliberations on waiver requests, so that during the Board panel's deliberation, the contents of a request for waiver of Rule XI(f) -- along with the requestor's past exam performance and scores -- are subject to discussion.  If your waiver request is granted, the staff of the Board, at its discretion, may require that you also file a Supplemental Investigation ("S.I.") Form as one of the conditions that must be met before admission to take an exam. Additionally, you must agree that the Re-Application will not be considered as filed, and that the time required for processing an application (and completing any investigation) shall not begin, unless and until the request for waiver of the five-time limitation is granted and the Board in its sole discretion has determined that any conditions it may prescribe for taking another exam have been met.
